All of your personal data is not necessary when browsing the site. However, they can be requested when making contact in the section dedicated to this purpose.
Article 1: object
The general conditions of sale (CGV) apply to all orders for services concluded between the client and Bryan Tulpin (the photographer), self-employed photographer and videographer.
The General Terms and Conditions defined below apply to all orders and all sales of services.
Article 2: Price
The sales prices are those applicable at the time of the order. Prices are inclusive of all taxes. As a self-employed person, the photographer is not subject to VAT: Article 293B of the CGI. The quotes established by the photographer are valid for a period of 3 months; after this date, prices cannot be guaranteed.
Article 3: Reservations
The customer can make a reservation by email, by telephone or directly on the site via the “Contact me” section.
The contractual information is presented in French and will be confirmed at the latest when your reservation is validated.
The photographer reserves the right not to record a payment, and not to confirm a reservation for any reason whatsoever, and more particularly in the event of an availability problem, or in the event of a difficulty regarding the reservation received.
Article 4: Validation of reservations
Any order placed by the customer is firm and final and entails acceptance of the General Terms and Conditions. The customer will sign the quote with the words “Good for Agreement”.
No modification of the order can be made except by mutual agreement and after modification of the quote by the photographer according to the additional services possibly desired by the client. The initial quote signed by the customer will continue to bind the parties as long as a possible amending quote has not been signed by him. If during a previous order, the customer has not met his obligations (default or late payment), he may be refused service unless he pays in cash. No discount for cash payment will be granted.
When you order, the invoice is sent by email in PDF format.
Article 5: Payment
The balance may be paid by the client on the day of the service provided by the photographer. In the event of distance selling, the latter will inform the customer when the files are ready to be delivered by email and delivery will take place upon receipt of payment. The balance of the service is payable within 10 days from the moment the customer has been informed that the photos are ready. Any late payment will give rise to the payment of interest at the minimum rate provided for in Article L 441-6 of the Commercial Code (legal interest multiplied by three), payable automatically and without reminder, calculated on the amounts including tax.
Orders placed will be paid by ®PayPal or by secure bank transfer. It is also possible to pay by check.
Article 6: Location and performance of the service
The photographer undertakes to carry out his work only in Reims at the client's home or in the streets of the locality, unless the client undertakes to pay travel costs, which will be detailed in the quote or the final invoice. The location of the shooting session must therefore be provided.
The services will be carried out on the date and at the address chosen by the customer and according to their authorizations (see Article 7) outdoors or indoors.
The photographer cannot be held responsible for the total or partial impossibility of providing the requested service when the fault lies with the client if he does not show up or if he is significantly late for the appointment.
Article 7: Authorizations – Image rights
The client undertakes to ensure that the photographer is not disturbed by third parties during the shooting. The client undertakes to obtain all authorizations necessary for the photographer to carry out the services, and in particular authorizations or agreements for taking photographs in certain monuments (cathedrals, churches, etc.). The photographer cannot be held responsible in the event of non-performance of the services. The client will assume for the photographer the consequences of any complaint or conviction made against the photographer in respect of shots for which the client has failed to request the necessary authorizations.
I am committed to preserving the confidentiality of your personal information. These will not be disclosed or used for purposes other than those for which you have given me your express authorization.
Article 8: Availability
The services are offered as long as they are visible on the site.
In the event of unavailability of a service after making the reservation for whatever reason, the customer will be informed by email or telephone. The reservation will be automatically canceled and the customer will be offered another date or a refund.
Article 9: Delivery/Shipping
Shipments will be made after payment of the entire invoice. The delivery times expected when ordering are immediate if sent by email. A delay does not entitle the customer to cancel the sale or refuse orders. No complaints will be admissible after 14 days from the delivery date.
Article 10: Intellectual Property
The photographs taken are and remain the intellectual property of the photographer according to the rules of articles L 121-1 et seq. of the Intellectual Property Code. The rights to photographs transmitted on hardware or computer media are strictly limited to strictly private use or within the family context. Any use of the photographer's photos beyond this use and without his written authorization constitutes counterfeiting within the meaning of article L 335-2 of the same code, and is punishable, under this article, by penalties of up to 'to 3 years' imprisonment and a fine of €300,000.
Article 11: Limitation of damages in the event of poor performance of the contract;
In the event of loss or deterioration of the photos, no longer allowing the full performance of the services initially agreed, the compensation may only be at most equal to the price of the initial service.
Article 12: Applicable law
The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
